Delivery, Collection and Risk

Optima will make every reasonable effort to complete and deliver orders by the agreed date. However, delivery dates are estimates only and, whilst we endeavour to meet them, we shall not be liable for any delay or failure to deliver where such delay or failure arises from circumstances beyond our reasonable control. No compensation shall be payable in such circumstances.

Ownership of Goods

Ownership of the goods shall remain with Optima until payment has been received in full and cleared. Until full payment is made, title to the goods shall not pass to the Customer.

Inspection of Goods

Customers are required to inspect all goods upon receipt and before accepting delivery.

Any shortages, defects, damage, or discrepancies must be reported to Optima within forty-eight (48) hours of receipt of the goods. Failure to notify us within this period may result in the claim being rejected.

Where goods are delivered, Customers should ensure that any visible damage is noted on the delivery documentation at the time of receipt. We shall not be liable for replacing, repairing, or refunding goods that have been accepted without inspection or where damage was not reported within the required timeframe.

Collection of Goods

Where the Customer elects to collect the goods from one of our premises, delivery shall be deemed to have taken place upon collection. At that point, all risk of loss, damage, or deterioration shall pass to the Customer.

Customers are expected to collect their goods within a reasonable time and during normal business hours.

Delivery of Goods

Where delivery has been requested, the Customer shall ensure that a responsible person is available to accept the goods at the agreed delivery address during normal business hours.

Delivery shall be deemed complete once the goods have been delivered to the agreed address. Upon delivery, all risk of loss, damage, or deterioration shall pass to the Customer.

Failed Deliveries

If the Customer is unavailable to accept delivery, Optima reserves the right to:

  • Deliver the goods to the nearest suitable collection point or outlet;

  • Arrange an alternative delivery date; or

  • Return the goods to storage.

The Customer will be notified by telephone, email, or other reasonable means.

Where a second delivery attempt or alternative delivery arrangement is requested by the Customer, additional delivery charges may apply.

Storage of Goods

Should collection or delivery be delayed due to the Customer's actions or failure to accept delivery, Optima reserves the right to store the goods at the Customer's sole risk and expense for a period of up to twenty-eight (28) days.

Storage charges may be applied where applicable.

Non-Payment

Optima reserves all legal rights and remedies available under applicable law to recover any outstanding payments due for goods supplied, including goods that have been manufactured, prepared, or made available for collection or delivery but remain unpaid.

Nothing in these Terms shall prejudice Optima's right to pursue legal action for the recovery of debts, costs, interest, or any other amounts due.
